Minutes | Meeting of the Board Accountability Mechanisms Committee (BAMC) | 26 March 2024

ICANN organization Attendees: Casandra Furey (Associate General Counsel), John Jeffrey (General Counsel and Secretary), Elizabeth Le (Associate General Counsel), Wendy Profit (Board Operations Senior Manager), and Amy Stathos (Deputy General Counsel)

The following is a summary of discussions, actions taken and actions identified:

  1. Agenda review – The Chair reviewed the agenda for the meeting.

  2. Procedural Evaluation of Reconsideration Request 23-2 – The BAMC Chair briefed the Committee on the meeting between some members of the BAMC and the Requestor that took place during ICANN79 regarding Request 23-2. The BAMC Chair noted that the Requestor is considering whether to pursue or withdraw Request 23-2 in light of the 7 March 2023 Board Resolution, which made approval of the initial ICANN Grant Program applications "dependent" on the successful completion of both "the Chartering Organizations' updating of the CCWG-AP Recommendation 7" and "full implementation" of the Fundamental Bylaws Amendment process. The Committee noted that the 135-day Bylaws mandated deadline on a reconsideration request expires on 5 April 2024 and agreed to give the Requestor until 1 April 2024 to provide the Committee with a response. The Committee continued its discussion on the procedural evaluation of Request 23-2 and suggested some revisions to the summary dismissal for further consideration by the BAMC.

      • ICANN org to ensure revisions suggested by the BAMC are made to the summary dismissal for further consideration by the BAMC.
  3. Update on IRP Implementation Oversight Team (IRP-IOT) – The Committee received a status update on the work of IRP-IOT.
  4. Update on Establishment of IRP Standing Panel – The committee received a status update on the work of the Establishment of IRP Standing Panel.
  5. Litigation Update – The Committee received a litigation update.
